End User License Agreement for Talk As Yourself (TAY)

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User" or "you") and Talk As Yourself ("TAY", "we", "us", or "our"), including its owners, operators, affiliates, and agents. TAY is an anonymous discussion site intended solely for information sharing among users. By accessing, using, or registering for TAY's services (the "Service"), you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must not use the Service.

1. Acceptance of Terms

Your use of the Service constitutes your acceptance of this Agreement. We may update this Agreement from time to time, and your continued use of the Service after such updates signifies your acceptance of the revised terms. It is your responsibility to review this Agreement periodically.

2. Description of Service

TAY provides an anonymous platform for users to share information through anonymized messages. All communications on the Service are anonymized to protect user privacy. The Service is provided "as is" and "as available," without warranties of any kind.

3. User Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. License Grant

Subject to your compliance with this Agreement, TAY grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes related to information sharing only.

5. User Obligations and Prohibitions

You agree to use the Service in accordance with all applicable laws and this Agreement. Specifically:

• Compliance with Guidelines: You agree to comply with TAY's guidelines, which emphasize that the Service is for anonymous information sharing only. Any use beyond this scope is prohibited.

• Prohibited Conduct: You shall not engage in or promote:

• Hate speech, discrimination, or harassment based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic.
• Profanity, obscene language, or vulgar content.
• Sexual exploitation, including but not limited to solicitation, explicit content, or any form of abuse.
• Soliciting, planning, or engaging in illegal activities of any sort.

• Any other unlawful use of the Service, including but not limited to fraud, defamation, intellectual property infringement, or violation of privacy rights.

• Anonymity Restrictions: You agree not to attempt to connect with, identify, or communicate with other anonymous users in any way other than through the anonymized messages provided by TAY. This includes, but is not limited to, sharing personal information, using external tools to de-anonymize users, or attempting to bypass TAY's anonymity features.

Violation of these obligations may result in immediate termination of your access to the Service, without notice or refund (if applicable), and may lead to legal action.

6. Release of Liability

You hereby release TAY, its owners, operators, affiliates, employees, agents, and successors from all liability, claims, demands, damages, losses, or expenses arising out of or related to your use of the Service, including but not limited to: - Any interactions or communications with other users. - Any content you post or encounter on the Service. - Any consequences resulting from anonymity breaches attempted by you or others. - Any unlawful or prohibited use of the Service by you or third parties.

This release applies to the fullest extent permitted by law and includes waiver of any rights under applicable statutes, such as California Civil Code § 1542 or similar laws.

7. Indemnification

You agree to indemnify, defend, and hold harmless TAY, its owners, operators, affiliates, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to: - Your use of the Service. - Your violation of this Agreement, TAY's guidelines, or any applicable law. - Any consequences stemming from your interactions on the Service, including attempts to connect with other users outside of TAY's anonymized messaging system. - Any content you post or actions you take on the Service.

8. No Warranties

The Service is provided on an "as is" and "as available" basis. TAY disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by law, TAY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service, even if advised of the possibility of such damages.

10. Termination

TAY may terminate or suspend your access to the Service at any time, for any reason, including violation of this Agreement. Upon termination, your license to use the Service ends immediately.

11. Governing Law

This Agreement shall be governed by the laws of the State of California, USA, without regard to conflict of laws principles. Any disputes arising under this Agreement shall be resolved exclusively in the courts located in San Francisco, California.

12. Miscellaneous

• Severability: If any provision of this Agreement is held invalid, the remainder shall continue in full force.
• Entire Agreement: This Agreement constitutes the entire understanding between you and TAY.
• No Waiver: Failure to enforce any provision does not constitute a waiver.
